LEGISLATIVE UPDATE
These are our two bills that PASSED during the 2007 Legislative
session:
HB1962 Summary as introduced:
Prescription of certain controlled substances and devices
by licensed physician assistants. Authorizes licensed
physician assistants to prescribe Schedule II through VI
controlled substances and devices on and after July 1, 2007.
HB1962, whose patron is Delegate John O'Bannon has passed
signed by the Governor and is now law, which is in effect
on July 1 2007. I want to give thanks to Zane Reasoner for
attending the house committee hearings AM and assisting
with this legislation prior to its filing.
Summary as passed:
SB993 Disabled parking. Allows licensed physician
assistants, licensed podiatrists, licensed chiropractors,
or licensed nurse practitioners the same certification powers
granted licensed physicians and certain other health care
professionals in connection with obtaining various indicia
associated with disabled parking privileges.
SB993 whose patron is Senator Harry Blevins Allows licensed
physician assistants, licensed podiatrists, licensed chiropractors,
or licensed nurse practitioners the same certification powers
granted licensed physicians and certain other health care
professionals in connection with obtaining various indicia
associated with disabled parking privileges. The bill has
passed has passed and was signed by the Speaker of the House
and President of the Senate and awaits the Governor signature
and become law on July 1 2007.
The following are two bills that were introduced but did
not pass during the 2007 Legislative session:
Summary as introduced:
HB2416 Exceptions to immunity of physicians; nurse practitioner
or physician assistant orders test. Adds to the exceptions
to physician immunity for laboratory tests the physician
did not order tests that were ordered by a nurse practitioner
or physician assistant with whom he or another physician
in his office had established a relationship with in writing.
Such physician must have been provided the results of the
test and failed to provide the same to the nurse practitioner
or physician assistant for the exception to apply.
HB2416 whose patron is Delegate Clifford Athey, Jr. the
immunity legislation was referred to the House Courts of
Justice Sub-Committee: Civil Law. Where it will remain till
the next secession. The bill had opposition as it is currently
enrolled by both the MSV and the Trial Lawyers Association.
This is a co-bill we have entered into with the NPs and
the upper sections of amendment are where the two organizations
are in disagreement. The lower portions are not a problem,
which is what the PAs need to have the same immunity as
there supervising physicians. The lobbyist for the NPs is
working with the legislation.
SB980. Summary as introduced:
Supervision of physician assistants. Expands the
therapeutic activities that licensed physician assistants
may perform under the supervision of a licensed physician
or podiatrist to include treatment. The bill prohibits physician
assistants from prescribing or dispensing drugs, except
prescriptive authority authorized for licensed physician
assistants pursuant to § 54.1-2952.1.
The patron at my request struck this bill when a reasonable
compromise with the Medical Society of Virginia's suggested
substitute amendment in order to gain their support and
not opposition was unattainable. The good new regarding
SB980 is we live to fight another day and with some additional
education of the MSV we should be able to gain their full
support for the original legislation at the 2008 secession.
